Replies to Questions Posed by JAPAN[1] Regarding the
New and Full Notification of KOREA [2]

The following communication, dated 25 April 2012, is being circulated at the request of the Delegation of Korea.

Question 1

Please clarify the eligibility criteria for receiving the subsidy if there are any criteria other than those listed in "item 6".

Under the "Act on the Promotion of Saving and Recycling of Resource", the subjects of the programme are different in each areas as follows.

- Fund for facility is provided to recycling company for establishing recycling devices.

- Fund for commercializing developed technology is provided to recycling company which facilitates production or commercialization of developed technology.

- Fund for technology is provided to R&D activities with regard to resource recycling.

- Fund for stabilizing management is provided for enhancing competitiveness of recycling company.

- Fund for supporting distribution and sale is provided to distributing and selling company of recycled product as well as establisher and operator of recycling center.

· Detailed Standard of Subject for Loan

- The loan is provided for small and medium-sized companies defined in the Article 2 of the Framework Act on Small and Medium Enterprise. (For manufacturing business, the eligibility of the support is limited to companies with less than 50 billion won of annual sales.)

- The company must have domestic business registration, and also have the waste disposal license and the certification of declaration of establishing waste disposal facilities.

o The waste disposal license covers waste collection and transportation, mid-recycling of waste, final recycling of waste, and comprehensive recycling of waste.

- The support is provided to the facilities that are established and used after the submission of the loan application. In case a company builds second-hand facilities, it should submit the appraisal report by an official appraisal institute.
